BADGER HILL ASSOCIATION
CONSTRUCTION GUIDELINES

 
The following rules and regulations are to be complied with by the general contractors, subcontractors and suppliers in the performance of construction activities for the Association or any lot owner within the subdivision.  Non-compliance of these rules will result in monetary fines, suspension of work in progress or the barring of a contractor, subcontractor or supplier from future activity with the subdivision.
 
1) Prior to any work for the association or on a lot within the subdivision, the following items are to be               complied with:
 
    a. Certificates of insurance must be on file with the Association,
    b. A list of contractors, subcontractors and their employees must be given to the guard gate,
    c. A trash dumpster must be placed on the job site when framing begins for disposal of surplus construction         material and garbage generated by the workmen’s activities.  Trailers are not allowed!
    d. Portable sanitation facilities must be in place prior to the commencement of work and must be                      continuously maintained in compliance with the rules and regulations established by Tulare County Health        Department,
    e. Parties supplying materials to the project site must indicate the contractor for whom they are making the        delivery and the lot number on which construction is taking place, and
    f. Written notices will be forwarded to the homeowner and contractor for infractions of the rules.
 
2) The following rules shall apply during the construction period to all contractors:
 
    a. Initiation of construction or delivery of materials shall not take place prior to 6:30 AM,
    b) All construction work shall cease by 6:00 PM,
    c) All construction workers shall be off the premises by 6:30 PM,
    d. Each lot under construction must have 15’ of crushed rock (from curb line into lot) and width of driveway        for workers ingress and egress to prevent tracking of dirt onto roadways of Badger Hill.  This must also be        done for other access routes utilized by lot under construction.  During the rainy season straw socks              must also be placed on all areas of access to the lot under construction to help prevent runoff,
    e. Streets are to be maintained free of dirt, spilled concrete and debris at all times.  If necessary, the                 contractor shall take steps to clean the street in front of the construction site, at grade breaks and               intersections where spillage has occurred on a daily basis,
     f. Trash dumpsters are to be emptied periodically to avoid scattering of debris and garbage on to adjacent          properties,
     g. Maximum load limits are established as follows:
             i.  7 ½ cubic yards of ready mix per load
            ii.  10 cubic yard of material on ten wheels
 
                 NEW HOMES – MAXIMUM NUMBER OF LOADS THROUGH FRONT GATE – 20, BACK GATE ACCESS                      ROAD MUST BE USED FOR ADDITIONAL LOADS OF FILL, ROCK, ETC.  MANNING THE GATES AT THE                  EXPENSE OF THE LOT UNDER CONSTRUCTION
 
                 REMODELS – BACK ACCESS ROAD MUST BE USED FOR ALL FILL, ROCK, ETC.  MANNING THE GATES                  AT THE EXPENSE OF LOT DOING REMODEL
 
             iii. Homeowner and/or contractor are responsible for all road damages during construction.
    h. Semi-trucks and trailer rigs are not allowed through the front gate, exceptions to this rule are moving             vans and sod trucks,
     i. Low-boys with equipment to wide to go through the front gate must use the back access road.  Arra             Arrangements must be made with Badger Hill personnel to open the gates on this road prior to delivery,
     j. Speed limit is 25 MPH for all vehicles, a fine system as been devised for violations of this rule and will be         imposed on offending parties.  Offending parties who continue to use excessive speed, after written               notification has been received, will not be allowed through the gate,
     k. Two (2) wheeled vehicles are prohibited within the subdivision for contractors, subcontractors and                 workers on the hill, parking for these vehicles may be arranged at the base of the hill with the gate               attendant,
     l. Generators are not allowed on the building sites due to noise, temporary power may be obtained from             Southern California Edison for the early phase of construction,
     m.Radio noise must be kept to a minimum on the building sites so as not to disturb existing residents of the         subdivision,
     n. Curbs and gutters damaged during construction by contractors and subcontractors must be replaced             (as needed) to Badger Hill specifications prior to completion of home and prior to balance of security               deposit being released,
     o. Badger Hill fire hydrants may be used for filling water trucks during the excavation phase of new                   construction only; any damages or repairs to the hydrant will be the responsibility of the                               homeowner/contractor using the hydrant.  Homeowner/contractor must notify office of the intended use         of hydrants.  Meters must be used on the fire hydrants.  Homeowner/contractor will be billed for water           used on project,
     p. Water meter, pressure regulator, etc. must be installed immediately following excavation phase.  Direct           access into water line is not allowed.
     q. Common area fences (pasture fence) may not be cut, the nearest gate should be used for common area          access,
     r. Adjacent lots may not be used for storage of building materials or access to lot under construction               without written approval from lot owner, written approval of lot owner must be given to the Association,
     s. Any excess excavation dirt hauled to the pit must be clean of debris, pushed in and leveled to natural             grade, contractors requesting dumping privileges in this area must post an additional $1,000 security               deposit to insure this rule is complied with, this deposit is on a per lot basis,
     t. Hauling of imported dirt, or dumping in the pit, is not allowed on Saturday or Sunday, this includes lot to          lot transfers,
     u. All construction signs must be removed when project is completed,
     v. Tires, railroad ties, miscellaneous construction materials, etc. may not be left curbside, and
     w. Construction work is not allowed on Sundays or the following holidays:
 
         New Year’s Day, Memorial Day, 4th of July, Labor Day, Thanksgiving or Christmas.
 
3) The following security deposit fees shall apply to construction within the subdivision:
 
    a. A $5,000 security deposit will be posted, by homeowner or general contractor, with the Association to             insure compliance with the above stated rules.  Funds remaining at the completion of construction will             be refunded, without interest, to the posting party when the adjacent lots have been cleaned, debris in         common area picked up, landscaping completed and necessary repairs to the curbs, gutters and                     roadways have been completed.
    b. Contractors requesting dumping privileges in the pit area must post an additional $1,000 security deposit         per lot.  This deposit will be refunded when dirt hauled to area has been pushed in and leveled to natural         grade.
    c. Remodels, swimming pools, landscaping installation or other major projects requires a security deposit of           $1,000 to be posted with the Association to insure compliance with the construction guidelines.  Funds           remaining at the completion of the project will be refunded, without interest, to the posting party.
